No more doubting

I can answer that question posted yesterday.  Yes I am a man (woman).  Yes, I’m tired of being attacked by the government with supposedly all the power.  But God is more powerful.  My faith is in Him.  No more will I wonder what is going to happen.  My faith will carry me.  It was ridiculous to raid me in the first place.  In spite of their brainwashing, they are going to see the error of their ways.  God will do it.  Someone will step forward and say, “Why are we doing this to a good woman?”  And it will all be over and I can help people.  I don’t intend on going back to primary care, however.  I’m too old to build a practice especially when I won’t take insurance.  Even though there are a lot of poor people without medical care.  But if they are smart, they will use alternative medicine anyway, and I can then help them.  I will also do prolotherapy.  That actually stops the need for opiates because it fixes the cause of the pain.  With those two things, I can make the world a better place.  I can even do medical missions and help people overseas.  There are lots of things I’m going to do.  And I know God is going to see that I get them done.  So enough of the “poor pitiful me” mentality.  On with the I’m a winner” mentality.  And things will work out.

I am having so much fun getting people and companies to line up helping me with my book launch.  In addition to being a good person, I’m going to be an Amazon best selling author.  Yippee!!  I should be able to retire on that and write more books.  Go on trips.  Tour the country.  Lots to see and do before I die.

IF
By Rudyard Kipling

If you can keep your head when all about you
Are losing theirs and blaming it on you;
If you can trust yourself when all men doubt you,
But make allowance for their doubting too;
If you can wait and not be tired by waiting,
Or, being lied about, don’t deal in lies,
Or, being hated, don’t give way to hating,
And yet don’t look too good, nor talk too wise;

If you can dream – and not make dreams your master;
If you can think – and not make thoughts your aim;
If you can meet with triumph and disaster
And treat those two imposters just the same;
If you can bear to hear the truth you’ve spoken
Twisted by knaves to make a trap for fools,
Or watch the things you gave your life to broken,
And stoop and build ’em up with wornout tools;

If you can make one heap of all your winnings
And risk it on one turn of pitch-and-toss,
And lose, and start again at your beginnings
And never breath a word about your loss;
If you can force your heart and nerve and sinew
To serve your turn long after they are gone,
And so hold on when there is nothing in you
Except the Will which says to them: “Hold on”;

If you can talk with crowds and keep your virtue,
Or walk with kings – nor lose the common touch;
If neither foes nor loving friends can hurt you;
If all men count with you, but none too much;
If you can fill the unforgiving minute
With sixty seconds’ worth of distance run –
Yours is the Earth and everything that’s in it,
And – which is more – you’ll be a Man, my son!

I have informed Jenny Waering, the US Attorney that is spearheading the latest attack, through my federal public defender that I will not succumb to their plea offer of being guilty of Medicare Medicaid fraud and drug trafficking.  The indictment should be April 12.  Then I’ll face trial.  I believe I have lived to the highest aspirations of this poem, and will continue to do so.  I believe in a powerful God.  He will protect me.  I will serve Him.  Hopefully he will use his power in the trial to save me from prison, but even if he doesn’t, I will still trust Him to use me wherever he chooses.

I saw the following notice in AAOM newsletter:

We received the sad news that Kent Pomeroy, MD passed away. He will be missed.

“God Bless Kent Pomeroy
He passed away peacefully during the night.
He was a Physicians Physician
We will not soon see the likes of him again
He will be missed dearly
Our Hearts go out to his Family and Friends”
      Dr Bruce H Shelton MD MD(H) DiHom FBIH
      President of AHIMA

Dr. Pomeroy was one of the pioneers in prolotherapy.  He collected a compendium of research done on proloptherapy to present at the workshops I attended.  He gave talks and did demonstrations.  I value what he taught me and hope that someday I can put it back to use.

A patient in Huntington W VA is suing his former doctor, Anita Dawson, claiming she, 10 other unnamed doctors and 10 unnamed pharmacists are responsible for his addiction.  This is unbelievable, but understandable in the waive of blaming doctors for addiction simply because they prescribe opiates.  This is the result of the government’s policy of a medical cause of addiction: that exposure to opiates cause addiction and that there is something innate in the opiate that causes this.  The whole concept of a medical cause of addiction is wrong.  But because the government says so, the people believe.  When are the people going to stop falling for the lies the government dishes out?  The opiates do not cause addiction.  Addiction is caused by depressed living conditions, anxiety and toxicity.  If the government would understand the real cause and work to eliminate those three conditions, drug abuse would go down.  Instead, they attack good pain management physicians, put legitimate patients on the steet looking for pills of whatever strength they can get, causing addiction and death by overdose.

After reading the article about the lawsuit, I looked up Dr. Dawson.  I found out she was a government target.  She has also lost her medical license indefinitely by voluntarily surrendering it.  She was probably looking at the big club the government holds over your head when they target you.  That is Medicare-Medicaid fraud.  Since any doctor can be charged with fraud and the government can usually throw enough at you that one charge will stick, they pretty much have us over a barrel.  You see, if found guilty of one charge of Medicare/Medicaid fraud, there is a mandatory 20 year prison sentence.  This is not alterable by judge or jury.  Most jury members are not aware of this, so they might find the doctor guilty of one out of 300 charges.  What they don’t realize is that one guilty verdict is the same as 300–20 years in prison.  That’s why you see most doctors charged with prescribing illegally will take a plea.  The plea is usually less than 20 years.  Even if they are innocent of the charge, the possibility of a 20 year mandatory sentence would make anyone take a plea.  Unless it’s a matter of principle and 20 years in prison doesn’t scare you.  Sometimes we have to stand up to evil.

I hope I will be able to help Dr. Dawson in her defense from this law suit.  I will try to offer my services.  We’ll see that happens.

http://www.albertleatribune.com/2012/03/23/victory-is-temporary-pain-is-forever/

Here is an article where at least one of the most important points people need to realize is addressed.  If people have ever had a bad pain, and then thought about what life would be like if they had pain like that forever, they would stop trying to eliminate pain management from the people that need it.

Pain is the absolute worse condition a person could ever experience.  Chronic pain is, in my opinion, worse than cancer.  At least with cancer you know the pain will end.  When you have a chronic pain condition, you know the pain will never end.  When the government keeps coming in and shutting down the doctor that is treating you, your anxiety level increases.  Not only does that increase your pain, but it leads to drug addiction.

The point at which the horribleness of pain was brought home to me was one winter morning.  In SW Virginia we often have ice storms or freezing rain instead of snow.  We had ice and freezing rain all night one night so that when you woke up the world was like a skating rink.  In approximately 10 years, I had never missed a day at work because of the weather.  I always got there even though often I was the only one.  That morning I started down the driveway and found out I had no brakes on ice.  At the bottom of the driveway, the car continued to go straight as it slid over the ice, instead of turning on to the street.  I finally stopped when the wheels ran into the ditch across the road.  I decided there was no way I was going to get to the office with the roads a sheet of ice.  I waited until 10:00 to allow some melting and traction.  I still had difficulty traveling with a four-wheel drive vehicle.  When I got to the office there were 3 cars with patients waiting on me in the parking lot.  Their cars were two-wheel drive.  How they made it I’ll never know.  All I knew was that they were willing to take their lives in their hands in trying to get their pain medicine.  The idea of going without medicine and being in pain was enough of an incentive to take a chance.  Now heart disease and diabetes will kill you.  But I don’t think there is a patient in the world that would have taken that kind of a chance to fill their blood pressure medicine or insulin.  But pain is a driving force.

Is the Justice Department really that callous that they don’t care about what they are doing to people in pain?  You bet they are.  For more information on that, tune in to my trial which should start sometime this summer.

http://www.vanguardngr.com/2012/03/we-live-in-pain-anguish-everyday-pensioners/

In Nigeria people are lined up complaining about not getting their government pensions for years.  People are dying.  Our government wants the same thing to happen to our retirement age people.  As a physician that kept people healthy and well, saving the government hundreds of thousands if not millions of dollars, I was (and am) proud of what I did.  And what do I have to show for it from the government?  I’m a felon.  Beware, people of America.  The government doesn’t want you healthy and well. The government wants you sick and die young before the age of 65.  Eat that sugar, drink that caffeine.  Take that flu vaccine.  Destroy your immune system and develop chronic disease.  Use the heck out of the sickness care system that we have invented for the pocketbooks of the rich, and then DIE!!!

We are not far off from this same situation the elderly in Nigeria are facing.  At what point will our government run out of money for our social security?  They are already planning on deciding who among us gets what medical services.  This bill got taken out once, but it will come back again and again.  Eventually our government will decide who among us lives and who dies.  And I can bet you it will be the moneyed and the powered that live while the 95% rest of the country will be killed off.  Legally, of course, but dead none the less.

If you don’t want to be one of the ones that is disposable, work on your lifestyle.  Take responsibility for your health.  Use alternatives.  Stop going to doctors that are owned by hospitals.  They work for the money.  Go to independent physicians that work for you.  And above all, understand that when the government targets one of us in the real medical profession that are pledged to help people, it is because we are helping people life long healthy lives–not what the government wants.

I have the following questions about the government attacking me this last time.

1.  If I broke the law in 2009 with the first accidental prescription I wrote to my second patient of the day, why did they wait 3 years to charge me?  After all, I was on probation with the stipulation that I not break the law.  That should be an easy one.  If I broke a law as they say, and the Board suspending my license for saying my explanation of a “mistake” was “not credible”, why didn’t they just march into my office and arrest me?  Why have they wasted 3 years of time and tax payers dollars with an “investigation”?

2.  Why didn’t Steven Tomaziefski inform me when I asked him about it in 2009?

3.  Why didn’t the Board of Medicine answer the questions I posed to them?

4.  Why am I the one responsible for the rules the other doctor laid down for how she would evaluate patients?

5.  Why did the other doctor get excused by the Board of Medicine while I received their wrath?

6.  Why did they have to drag the bottom of the US Code to come up with something they could say is the law we broke?  They charged us with running a “deceptive practice”?

The answer to all of these questions is this.  For 3 years of running my practice before the first attack, I demonstrated to the US government my ability to heal people, keeping the disabled and elderly alive and vital with the seven steps to healing.  People stopped using medicines, stopped going to the hospital, and stopped having diseases.  The government couldn’t stand it.  You see, the government doesn’t want us healthy and well.  They want us dependent on the Pharmaceutical Industry because of the $$$, using the hospitals for tests and surgeries because of the $$$, and going to regular conventional doctors because of the $$$ and that by doing so, people will die younger.

I offered to the government an option to Obamacare.  I could take care of patients for $1000-$1500 per year.  They wouldn’t need expensive tests or medicines.  With remedies and the seven steps to healing, my patients would be healthier at the end of a year than any group of patients followed by any conventional doctor.  People could buy an HSA account for catastrophic coverage instead of the expensive insurance they have to buy now.  I never heard from the government.  Instead they try to shut me up with another fabicated charge of breaking some fabricated law.  Well, they can stop me from practicing, but they can’t stop me from teaching or communicating good health, can they?  Especially with your help–the people who read this, spread the word, and support the work of those of us in medicine that actually follow the hippocratic oath.

(Continuation of previous 2 blogs)

The first doctor to help saw the patients in his own office, accepting them to his own practice.  He helped for two months.  Then Tomaziefski showed up one day in his office.  With intimidation and “We’re watching you”, that doctor decided he couldn’t take it, and stopped seeing the patients.  The second doctor was hired locum tenens.  The government stopped his being able to help by serving him with a subpoena to the Grand Jury.  So by June, 2011, 200 of the remaining patients were without a doctor again.  Meanwhile, 7 had died.  One wrote a suicide note not being able to tolerate the pain. The others shouldn’t have died.  Their deaths were probably related to not having their pain treated. But does the government care?  No.  The Virginia Board of Medicine set up action based on the charges that the DEA made.  The decision was made even before the 8 hours of testimony.  In spite of testimony from the patients who accidentally received prescriptions, the Board stated in their decision that my saying the writing of three prescriptions accidentally in 1 1/2 years was “not credible”.  They suspended my license for a year and charged me with breaking a US Code.

I asked the US Attorney to meet with me when I was acting pro se.  They showed their true colors during that meeting.  I pointed out to Jenny Waering, the US Attorney brought to SW Virginia to attack doctors, that I had written a letter to Tomaziefski explaining what we were doing and that it was his responsibility to tell me if it wasn’t okay.  Her reply shows what the US Attorney’s office is all about.  She said “We’re not obligated to tell you when your’re breaking the law.”  I knew, at that point, that they were going to use whatever they could, even if they had to fabricate it, to put me in prison.  That’s how desperate they are to prevent people from staying healthy in this country.

It has been 8 months since my license was suspended and one year ten months since the raid on my office.  The US Attorney has had multiple people tesify to the grand jury, but to my knowledge there has been no indictment.  I won’t describe the people they’ve gotten to testify, because the government is probably reading this blog and I wouldn’t want them to know what I know.  But it just goes to show how low our government goes to achieve their ends.

Finally, they have asked to meet with me and my lawyer.  Not having an income or savings, I am relying on the public defender’s office.  But I know that with God’s help, they will do what is needed.  We are meeting with the US Attorney next Thursday.  Hopefully we will soon have the trial underway.  You see, I want to go to trial.  The evil in the US government has to be shown to the world.  God is displeased with what this country has done with all of His blessings.  If I can be used to His purpose, I will be happy.  People need to be treated with more respect.  Shutting down legitimate doctors treating legitimate patients with legitimate pain has got to stop.  The articles you read about doctors found guilty of “prescribing without justifiable medical purpose” or “illegally prescribing narcotics” is a bunch of legal mumbo-jumbo that means absolutely nothing.  People need to realize that and stop believing all the lies fed to us by authorities that are working to simply save their own jobs with no regard to people’s lives.

Stay tuned and I will let you know what the government says next week.

I wrote a letter to Mr. Tomaziefski in May, 2009.  In it I told him what we were doing to ensure people had pain management, with the other doctor seeing and evaluating the patient, and I assisting her as a nurse practitioner would without prescription writing privilege.  I expressed my dissatisfation with his not getting me my DEA certificate.  Having found out about the pharmacy searches, I also openly admitted to mistakenly writing three prescriptions.  Two for the first two patients I saw on Feb 23, my first day back to work, and one for a drug, Lyrica, that I didn’t know was controlled.  The drug company agent had not told me it was, comparing it to neurontin which was not controlled.

In my letter to Tomaziefski, I told him that if what we (the other doctor and I) were doing was wrong, it was his responsibility to tell us.  If he didn’t tell us, he was responsible.  He never told us anything.  I sent the same letter to the disciplinary person at the Virginia Board of Medicine.  They never replied to it either.  However, 1 year later, in June of 201o, the government raided me again, with the charges of breaking the law because of the arrangement I had with the other physician.

The other physician and I both read the code, saw that we were following all the rules.  Since she was the one doing the evaluations and prescribing the medications, she felt like she was doing everything right and continued.  She continued through October, 2010 when her lawyer recommended to her to relinquish her DEA certificate in an “act of good faith” to take the heat off her.  So in one day, around 300 legitimate patients were again without pain management, searching for a doctor when none would take them.  You see, we specialized in taking care of the patients not accepted by most practices–the uninsured, Medicare and Medicaid patients.  For Medicaid patients living in SW Virginia to receive pain management, they are referred by most practices to UVA in Charlottesville, a 4 hour drive by Medicaid cab (your tax dollars at work).

Over the course of the next 6 months, God provided for most of the patients by sending us two other God-fearing physicians that helped.  However, the government wasn’t going to allow that to happen.

Round 2 begins

You know the saying, “You can’t fight city hall.”  What that means is that the government has all the power.  They have all the money.  What people like me find out is once you are a target, even if you haven’t done anything intentionally wrong, they’ve got you.  You have to give in or be squashed like a bug.  It’s a shame our government isn’t composed of statesmen like the founding fathers.  People with morals, people with integrity.  Instead today, we have people who are in it for the money, the prestige, and they don’t mind who they step on.  In the case of the US Attorney’s office, they don’t mind whose lives they ruin.  They want to protect their jobs.  Especially here in SW Virginia where people have been hired to positions just for the purpose of attacking doctors.  The money they got from the lawsuit with Purdue Pharma is earmarked for that purpose.  I happen to be one of the doctors in their crosshairs.  But I won’t go down without a fight.  Someone has to stand up for what is right and Godly.  Destroying people’s lives like they are doing is wrong.  God picked me for this purpose.  They have taken away everything from me–my retirement, my lifelihood, my respect.  There is nothing left that they can take away that means anything.  That is why I am the perfect person to fight them.  Even though I know, having been through this before, that I will probably go down.  At least I will go down fighting.  And this time the people will know the truth.  Because I’m going to tell you.  Through this blog I will be completely open as to what is going on.  If you read this, tell your friends.  Get the word out.  Make this blog be one that everybody reads.  By doing so you will find out how evil our government is and hopefully you will clean house and start over.  First, however, we must identify the statesmen.  The good people.  People that will run this country of the people, by the people and for the people.

My story (the second time around) started in 2009.  My license had been reinstated by the Virginia Board of Medicine after losing it from the first attack against me in which I accepted a plea agreement. I thought the government had gotten off easy on that one and would leave me alone, having found nothing wrong with my patient care or my pain management.  I was awaiting the recertification by the DEA.  However, Mr. Steven Tomaziefski, the local DEA agent, in cahoots with the US Attorney’s office, had another plan.  While awaiting my DEA certificate, another physician continued to see the patients and prescribe their medications.  Since my previous patients had been unable to find a physician willing to see them and they were in dire straights with pain, they started to come back to us.  If I wanted to take care of them again, I had the other doctor see them until I could take over.  After 3 months of waiting for my DEA certificate, I found out that Mr. Tomaziefski, along with a DHHS agent was traveling all over SW Virginia visiting pharmacies investigating prescriptions supposedly signed by me.  What they found out was that most were mistakes by the pharmacies.  But I still didn’t get my DEA certificate.   (To Be Continued)
